Personal Injury Lawyers in Melbourne

Personal injury claims in Victoria often run through one of two state schemes. Road and transport injuries are dealt with by the Transport Accident Commission, while workplace injuries are handled through WorkSafe Victoria and its agents. Other claims, such as public liability and medical negligence, usually depend on showing that someone else was negligent.

Every firm in this list advertises a no win, no fee arrangement, although the terms differ from firm to firm. Ask for the fee agreement in writing and read how costs and disbursements are handled if the claim succeeds or fails. Several of these firms have suburban offices across Melbourne, which can make meetings easier while you recover.

Injured at work

WorkSafe Victoria says you have 30 days from the injury date to report it to your employer, and the report should be made in writing. Your employer then notifies their WorkSafe agent, which has 28 days from receiving the claim to make a liability decision.

A lawyer may help if a claim is rejected or if payments stop. Keep copies of every form, certificate of capacity and letter you receive.

Road accidents and other claims

For transport accidents, the TAC says you have 12 months from the date of the accident, or from when an injury first becomes evident, to lodge a claim. It also needs a police report or the details of the officer you reported the accident to.

Public liability and medical negligence claims follow different rules and time limits. Get advice early, as evidence such as photos and witness details is easier to collect soon after the event. A first appointment is also a good time to ask the firm how long similar claims have taken and what the next steps would be.
