Car Accident Lawyers in Darwin

Road accident injuries in the Northern Territory are covered by the Motor Accidents Compensation (MAC) Scheme. TIO administers the scheme on behalf of the Northern Territory Government and describes it as a no fault scheme covering all road users, including drivers, passengers, pedestrians, motorbike riders and cyclists.

Injury claims under the scheme are lodged with TIO MAC. Because the scheme is no fault, many people start a claim themselves, and lawyers often become involved when a claim is not accepted, an entitlement is disputed or the injuries are serious. A local lawyer can explain how the scheme applies to your accident and what the review process looks like. Keep copies of every form, letter and medical report from the start.

Time limits and who is covered

According to the Motor Accidents Compensation Commission, adults should make a claim within 6 months of the accident. A claim made later but within 3 years may still be considered, while claims after 3 years will not be. For people under 18, the claim must be made within 3 years of their 18th birthday.

Some people may not be covered. The Commission says people injured in a motor vehicle accident during the course of their employment are not covered by MAC, though they may be eligible for workers compensation. Drivers or owners of unregistered vehicles may also miss out on benefits.

If you disagree with a decision

The Commission describes an optional internal review, which must be requested within 30 days of being told of the decision. A Designated Person review can follow, and the request must be received within 90 calendar days of the original decision. The last step is an appeal to the Motor Accidents (Compensation) Appeal Tribunal within 28 calendar days of the Designated Person’s decision.

Legal costs may apply at the tribunal stage, and the Commission suggests getting legal advice on both the process and the likely costs.
