Personal Injury Lawyers in Perth

Personal injury claims in Perth can follow a workplace accident, a road crash, a fall in a public place or medical treatment that went wrong. Each type of claim runs through a different system in WA, with its own insurers, forms and deadlines. Choosing a lawyer who regularly works in the right system can save time.

Many Perth injury firms are based in the city, with others in the suburbs and regional centres. Ask which types of claims a firm handles most often, who will manage your file and how fees work, including what you would pay if the claim does not succeed. Getting advice early can also help you keep the medical records and paperwork a claim may need.

Injured at work

WorkCover WA advises injured workers to seek first aid and report the injury to their employer straight away, then see a doctor of their choice for a First Certificate of Capacity. The worker completes a claim form and gives it to the employer, who must lodge it with its insurer. The insurer will then notify the worker within 14 days of receiving the claim form.

If a claim is not accepted, you can ask the insurer to reassess it. A dispute that stays unresolved can go to the conciliation and arbitration services run by WorkCover WA.

Legal costs in injury claims

Fee arrangements vary between firms. The Insurance Commission of Western Australia notes that lawyers may charge hourly, fixed or capped fees plus disbursements such as medical reports and court fees. It also says fees under a no win, no fee agreement can be up to 25% higher than the lawyer’s regular rates, and that lawyers are prohibited from charging contingency fees.

Ask for a written estimate early. Check what you would pay at each stage and how disbursements are handled if the claim ends early.
