Personal Injury Lawyers in Brisbane

Injury claims in Queensland follow different paths depending on how the injury happened. Workplace injuries usually go through workers’ compensation, while road injuries are claimed through compulsory third party (CTP) insurance. Brisbane injury firms often handle public liability claims too, such as falls in shops or on council land. Each scheme has its own forms and deadlines, so it helps to know early which one applies.

Many local firms offer a free first meeting to look at whether you may have a claim. Ask how fees work if the claim fails, and who will be your main contact while it runs. Bring any medical certificates and correspondence from insurers to that meeting, since these help the lawyer give clearer advice.

Workplace injuries and WorkCover

According to WorkSafe Queensland, WorkCover Queensland insures most employers, while some employers insure themselves and manage their own claims. There is usually a time limit for lodging a claim, often within six months of the date you were first seen by a doctor. A valid claim needs both a work capacity certificate and an application for compensation.

Employers must report a work related injury within eight days of becoming aware of it. That report is separate from your own claim, so lodging yours is still up to you.

Costs agreements with your lawyer

Many injury firms work on conditional costs agreements, often called no win, no fee. The Legal Services Commission says these agreements must be in writing, in plain language and signed by the client. They must also allow a cooling off period of at least five days in most cases.

Read the agreement before you sign and ask what you may still owe if the claim does not succeed. Under some agreements, outlays such as medical reports may be payable either way. If anything in the agreement is unclear, ask for it to be explained before you sign.
