Personal Injury Lawyers in Canberra

Personal injury claims in Canberra often fall under one of several schemes, and the rules depend on how and where you were hurt. Workplace injuries usually go through ACT workers compensation, although many federal public servants are covered by Comcare instead. Road injuries are handled under the ACT motor accident scheme, and other claims such as public liability or medical negligence follow their own process.

Because time limits apply to most claims, it is worth getting advice soon after an injury. Many Canberra firms offer a free first assessment, which can be a useful way to learn which scheme applies to you. Ask how fees will be charged and what you would pay if the claim does not succeed before you sign anything.

Injured at work in the ACT

Guidance from WorkSafe ACT says a worker must tell their employer about an injury as soon as possible. If you are unable to work for 7 days or more, the claim form and a Certificate of Capacity from your treating doctor need to go to the employer or insurer within 7 days. The insurer will then accept or reject the claim within 28 days.

Comcare claims for Commonwealth employees follow a separate process. A lawyer who handles both systems can tell you which one covers you.

Road and public injuries

According to the MAI Commission, anyone injured in a motor accident in the ACT can make a Personal Injuries Application for defined benefits, whatever the fault. These benefits can include treatment and care costs and income replacement for up to five years, plus a quality of life payment where an injury is significant and permanent.

Slips, trips and other public liability claims usually turn on whether someone failed in their duty of care. Photos, witness details and medical records gathered early can make a real difference to how a lawyer assesses the claim.
