Property Lawyers in Hobart

Hobart’s housing ranges from older cottages in Battery Point and North Hobart to hillside homes in Sandy Bay and newer estates on the Eastern Shore and around Kingston. Older homes and sloping blocks can come with easements, boundary questions or past building work that needs checking. A property lawyer can review the contract and title searches before you commit.

Many Hobart law firms handle residential conveyancing alongside leasing, subdivision and development work. Ask what is included in the fee and which searches will be ordered, and confirm who will look after settlement. For commercial, rural or agricultural land, check that the firm regularly acts on that kind of property, since issues such as water rights and easements can affect value.

Property transfer duty

Property transfer duty, previously called stamp duty, is a tax charged by the Tasmanian Government when you buy property. According to Service Tasmania, duty is payable by the buyer within 3 months of the date of the dutiable transaction, which is usually the date of settlement. The State Revenue Office has an online calculator that should be used as a guide only.

Your lawyer can confirm the duty on your purchase. Search fees and bank charges are usually listed separately from the legal fee, so ask for a full estimate.

Before you sign a contract

In many cases a contract for sale becomes binding once both parties sign, so it is worth having a lawyer read it first. Look closely at special conditions about finance and building inspections, along with the settlement date.

If you are selling, your lawyer can help prepare the contract and work with your bank to discharge any mortgage. For subdivisions or commercial leases, early advice on council approvals and lease terms may save time and cost later in the process.
