Family Lawyers in Adelaide

Family law in South Australia is federal law. The Federal Circuit and Family Court of Australia can hear most types of family law matters, including parenting orders, property division after a relationship ends and divorce applications. It also notes that it deals with most divorce applications outside Western Australia, which has its own family court, so Adelaide families deal with the federal court.

Many separating couples settle parenting and property arrangements through negotiation or mediation rather than a court hearing. A family lawyer can explain your options and, once terms are agreed, draft consent orders or a financial agreement. Several Adelaide firms in this list have family teams inside larger practices that also cover wills and property work.

Free help and legal aid

The Legal Services Commission of South Australia runs a Family Advocacy and Support Service at the Federal Circuit and Family Court in Adelaide. It offers duty lawyer and social support services to people with family law matters who are affected by family violence. Duty lawyers there can give advice and help with adjournments and legal aid applications, although they cannot prepare complex court documents such as affidavits.

Appointments are not needed for that service, but priority goes to people who have a hearing in court that day. The Commission also runs a free Legal Helpline, which may be a useful first step if you are unsure where to start.

Preparing for your first appointment

Bring a list of assets, debts and superannuation for both of you, along with any orders, agreements or letters already in place. Ask how the firm charges, who will handle your matter and how often you will hear from them.

Some firms in this list offer a set fee first session that covers your rights, likely costs and next steps, which can help you plan. If children are involved, it often helps to write down the current care arrangements and what you would like to change before the meeting.
