Personal Injury Lawyers in Adelaide

Personal injury claims in South Australia fall under different schemes, depending on how the injury happened. Work injuries are generally handled through ReturnToWorkSA and its claims agents, while road injuries go through the compulsory third party (CTP) scheme. Injuries in a public place, medical negligence and superannuation disability claims follow other rules again.

Many Adelaide injury lawyers handle all of these claim types, and several have offices in the northern and southern suburbs as well as the city. Some offer a free first appointment and can visit you at home or in hospital. Ask how fees are charged and when they are payable, as arrangements differ from firm to firm.

Time limits and notice

Time limits matter in injury claims. The Legal Services Commission’s Law Handbook says an action for negligence causing personal injury must generally be started within three years, and that a written notice of injury may also need to be served within six months under the court rules. Extensions are possible in limited cases, so getting advice early is often the safer course.

For work injuries, ReturnToWorkSA advises telling your employer straight away and seeing a doctor, who can provide a work capacity certificate if you have lost time from work. Claims are then managed by a claims agent, who contacts the worker to confirm they want to go ahead.

Choosing an injury lawyer

Ask who will run your claim day to day and how often you will hear from them. Bring medical reports, pay slips and any letters from an insurer to the first meeting, along with photos or witness details if you have them.

Some firms in this list focus mainly on injury and compensation work, while others have injury teams inside a larger practice that also covers family law, wills and business matters. Either can suit, so it often comes down to experience with your type of claim and how comfortable you feel with the lawyer.
