Car Accident Lawyers in Brisbane

In Queensland, injury claims after a road crash are made under the compulsory third party (CTP) scheme. According to the Motor Accident Insurance Commission, you lodge a claim form with the CTP insurer of the vehicle at fault, or against the Nominal Defendant if that vehicle is unidentified or unregistered. The crash must also be reported to police.

MAIC says you do not need a lawyer to make a CTP claim, and you can deal with the insurer yourself. Many people still get advice when injuries are serious or fault is disputed. A lawyer can also explain the strict timeframes that apply to lodging a claim. Getting advice early also leaves more time to gather medical evidence.

Steps after a crash

MAIC sets out the steps for a claim. Report the crash to police, note the registration of the vehicle at fault, then complete the claim form and gather supporting documents such as a medical certificate. If the crash was not reported at the scene, a Report of Traffic Incident to Police form can be taken to a police station.

The insurer will respond and give you a claim number once the form is lodged. Keep copies of medical records and receipts, as these may later support the claim.

Settlement and choosing a lawyer

A CTP settlement is final. MAIC’s information for claimants explains that once you accept an offer and are paid, you cannot make further claims for those injuries. Understanding your likely future treatment needs before agreeing can matter a great deal.

When comparing firms, ask who will run the claim day to day and how costs are worked out. Most Brisbane firms that handle CTP claims also act in other injury matters, so ask how much of their work involves road accidents. It also helps to know how often you will hear from them while the claim is running.
