Car Accident Lawyers in Sydney

If you are hurt in a road accident in NSW, your claim is usually made under the CTP green slip scheme. The State Insurance Regulatory Authority says drivers, passengers, riders, pedestrians and cyclists may claim. It adds that benefits may include treatment and care, income support payments and in some cases a lump sum. If the crash happened while you were working, a workers compensation claim may also be needed.

Sydney has a number of firms that focus on CTP claims, with offices in the CBD and suburbs. A lawyer can help you lodge the claim, deal with the insurer and work out whether you may also have a claim for damages. Time limits apply, so early advice is often worthwhile even if your injuries seem minor at first.

Time limits and minor injuries

The Law Society of NSW explains that if you were working and cannot work because of your injuries, you have 28 days to make a claim. Otherwise, weekly income support will not be paid from the date of the accident until you claim. It also says that if your injuries are minor, or you were wholly or mostly at fault, benefits last 26 weeks. Longer benefits may apply for more serious injuries where you were not mostly at fault.

SIRA says the insurer must make a liability decision within four weeks of the claim being lodged. If you disagree with a decision, you can ask for an internal review within 28 days, and after that you may apply to the Personal Injury Commission.

How a lawyer can help

A solicitor can advise whether to claim benefits, damages or both. They can also help collect evidence, complete forms and deal with the insurer if a dispute comes up. Some claims also involve workers compensation or Centrelink, which can affect what you receive.

Ask for a written costs agreement before you start and check what is included. Keep your own records of treatment, travel and time off work, since these details often matter later in the claim.
