Criminal Lawyers in Adelaide

Criminal cases in Adelaide are heard in the state courts run by the Courts Administration Authority, which publishes criminal case lists for the Adelaide Magistrates Court, the District Court and the Supreme Court. Young people from 10 to under 18 are dealt with in the Youth Court. After a charge is laid, the CAA explains that a person will either receive a summons to attend court later or be required by police to enter a bail agreement.

An experienced criminal lawyer can explain the charge and the likely process before your first court date. Many Adelaide firms also handle driving matters such as drink and drug driving, along with intervention orders. Getting advice early often gives you more time to gather documents and prepare.

Duty lawyers and legal aid

The Legal Services Commission runs a free Duty Lawyer Service at the Adelaide Magistrates and Youth Courts as well as metropolitan Magistrates and Youth Courts. Help is prioritised, starting with people in custody who want to apply for bail. The service is aimed at people who face disadvantage in court, such as a lack of financial resources.

According to the Legal Services Commission of South Australia, legal aid is not normally available for less serious offences where there is no risk of imprisonment. In those cases a private lawyer, the duty lawyer or the Commission’s free advice service may be the next step.

Choosing a criminal lawyer

Look for a firm that regularly appears in the court where your matter is listed, and ask who will appear for you on the day. Fees for a guilty plea are often quite different from a defended hearing or trial, so ask for an estimate for each stage.

Bring the charge papers, any bail agreement and the next court date to your first meeting. If your work depends on your licence, tell your lawyer early in a driving matter.
