Car Accident Lawyers in Adelaide

Injuries from a road crash in South Australia are generally claimed under the compulsory third party (CTP) scheme. The CTP Regulator says you do not need a lawyer to lodge a claim, although you can get legal advice if you want to. A claim generally needs someone other than the injured person to be at least partly responsible, and children under 16 are covered even if they caused the accident.

Timing matters. The Regulator advises lodging as soon as you can, and says you will need to give the insurer a reason for the delay if the accident was more than six months ago. Claims made more than three years after an accident will generally not be accepted. Adelaide car accident lawyers can help with the claim form, deal with the insurer and check any offer.

Serious injuries and the Lifetime Support Scheme

People with the most serious injuries may be covered by the Lifetime Support Scheme. The CTP Regulator lists moderate to severe brain injury, spinal cord injury, severe burns, blindness and amputation as eligible injuries, and says you may be eligible even if your CTP claim is not accepted.

The Regulator also has separate steps for crashes involving an interstate, unknown or unregistered vehicle. A lawyer can help work out where a claim should go in those cases.

Before you accept an offer

An insurer may make an offer before the full effect of your injuries is clear. It is often worth getting advice before you sign anything, particularly if you are still having treatment or cannot yet return to work.

Keep records of medical appointments, time off work and travel costs from the start. Bring your claim number, police report details and any letters from the insurer to your first meeting, and ask the lawyer how fees will be charged and when they are payable.
